Silicon Knights take Epic to court over failure to keep Unreal Engine promises

This one’s a blast from the past; back in 2007 Too Human developer Silicon Knights stirred up a lawsuit with Epic Games over a failure to keep promises made in licencing the Unreal Engine. The developer claimed that Epic failed to “provide a work game engine” and that they were “sabotaging” games using the engine by not spending money on improving the engine, rather putting it towards making Gears of War.

Sounds a bit crazy, right? Well, Knights have a chance to prove us wrong; they’ve been granted a shot at delivering their case to a jury. They sight allegations of fraud, negligent misrepresentation, unfair competition, breach of contract, and breach of warranty.

SK’s president Dennis Dyak is confident in his company’s chances: “When Epic first went public about our case to the press, they said that our claims were without merit. Two separate federal court judges have now disagreed with Epic, and have ruled that the case does have merit.”

“Silicon Knights has always wanted to have our focus be on making great games, not litigation. This ruling will allow us to have our day in court, before a jury, and to shine the light publicly on Epic’s conduct,” Dyack continued. “We are very confident the jury will see the truth behind Epic’s actions.”

So it’s Marcus Fenix vs… uh, the guy from Too Human, whoever that was.
