The current legal battle between Amazon and Apple over the use of the Appstore name looks to be tipping in the online retailer’s favor. It’s been revealed that the US district judge overseeing Apple’s lawsuit has said she will “probably” deny the motion. Apple have taken the online retailer to court due to the near-identical name.
Judge Phyllis Hamilton cited Apple’s inability to present evidence of confusion as the reason Amazon will likely win. She said of Apple: “I’m troubled by the showing that you’ve made so far, but that’s where you’re likely not to prevail at this early juncture.”
A final decision is yet to be made, though one lawyer place the blame on Apple for failing to prevent the name from falling into commonplace.
